1. Purpose and Scope

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and The Eddy Incorporated, operating as KBGrabNGo (“KBGrabNGo,” “we,” “us,” or “our”), governing your access to and use of the KBGrabNGo mobile application, website, and related services (collectively, the “Service”). By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

The Service is intended for individuals who have reached the age of majority in their province or territory of residence. By registering, you represent that you meet this requirement and that the information you provide is truthful and complete.

3. Account Registration and Security

1. To access certain features, you must create an account using a valid email address or telephone number and a secure password.
2. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
3. KBGrabNGo reserves the right to suspend or terminate accounts suspected of fraudulent, abusive, or unlawful activity.

4. Orders and Payments

1. Orders placed through the Service constitute an offer to purchase food or related products from participating vendors.
2. All payments are processed by Stripe, a third-party payment processor. KBGrabNGo does not store or retain payment card data.
3. You agree to provide accurate billing and contact information and authorize the processing of charges to your designated payment method.
4. Orders may be rejected, cancelled, or refunded at the discretion of KBGrabNGo or the vendor in accordance with these Terms and applicable law.

5. Cancellation and Refunds

1. You may cancel an order and obtain a full refund up to two (2) hours before the scheduled pickup time.
2. After that period, cancellation or refund requests may be denied at our discretion.
3. Refunds are issued only through Stripe and credited to the original payment method.
4. You may appeal a refund determination by contacting info@kbgrabngo.ca within seven (7) days of the decision.

6. Promotions and Deal Tracking

1. KBGrabNGo may track user interaction with promotional offers and notifications to improve relevance and effectiveness.
2. Such tracking may be used to personalize future offers. Users may opt out of personalization through their account settings or by contacting KBGrabNGo.
3. Promotional offers are non-transferable and may be withdrawn or modified at any time without notice.

7. Acceptable Use

Users shall not:

• Use the Service for unlawful, deceptive, or fraudulent purposes.
• Interfere with or disrupt the Service, its systems, or security measures.
• Misrepresent their identity or affiliation.

Violation of this section may result in immediate suspension or permanent termination of access.

8. Communications

By creating an account or placing an order, you consent to receive transactional communications related to your account and orders. You may unsubscribe from marketing communications at any time by following the opt-out instructions provided or by contacting KBGrabNGo.

9. Intellectual Property

All trademarks, logos, content, and materials displayed through the Service are the exclusive property of The Eddy Incorporated or its licensors. No rights or licenses are granted except as expressly authorized in writing. Reproduction, modification, or distribution of any portion of the Service without permission is strictly prohibited.

10. Limitation of Liability

To the maximum extent permitted by applicable law, KBGrabNGo and The Eddy Incorporated shall not be liable for any indirect, consequential, special, or incidental damages arising out of or related to the use of the Service, including but not limited to service interruptions, order errors, or vendor performance. The total liability of KBGrabNGo, whether in contract, tort, or otherwise, shall not exceed the value of the order giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless KBGrabNGo, its officers, directors, employees, and affiliates from any claims, damages, liabilities, or expenses arising from your violation of these Terms or misuse of the Service.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising under or in connection with these Terms shall be submitted exclusively to the courts of competent jurisdiction in Ontario.

13. Amendments

KBGrabNGo reserves the right to modify these Terms at any time. Revisions will be posted on the website and within the application. Continued use of the Service after such posting constitutes acceptance of the revised Terms.
